Knowing your burden of proof is the first consideration in your quest to prosecute your case.  No matter what your burden of proof is and no matter what forum you are prosecuting your case, the attorney must have a plan on how to achieve a successful prosecution of his or her case.

10:25 a.m. - 11:40 a.m.  Summary Jury Trials (SJT) in the Supreme Court-Queens County (1.5 Credit in Skills) 

Every attorney, whether for the plaintiff or the defendant, needs to become familiar with the SJT option and the value it represents. SJTs are by no means limited to low value cases.  SJT juries often return verdicts in the hundreds of thousands of dollars and the $1000,000 threshold has already been breached.

This presentation by Hon. Richard Lazarus will draw upon his multi-year experience with SJTs and address the advantages to litigators, both plaintiffs and defendants in electing an SJT as opposed to a plenary trial. Also covered will be the anatomy of an SJT, preparing for and conducting the all-important evidentiary hearing and content of the evidentiary packet. Sample templates will be provided for the packet, charges and verdict sheet. Strategy will be considered and there will be an interactive question and answer period.

11:40 a.m. - 12:05 p.m.  A View from the Bench: Common Mistakes Attorneys Make at Trial That They Later Regret on Appeal (0.5 Credit in Areas of Professional Practice) 

This segment will examine the importance of preserving arguments for appellate review and explore the common mistakes attorneys make in not protecting the record. Some of those mistakes include not making proper motions, failing to raise a specific objection, not moving for a trial order of dismissal on a specific ground, failing to request a mistrial, failing to put crucial sidebar discussions on the record, and failing to develop the record on evidentiary issues. The ultimate objective of the preservation rule is to provide an opportunity for the trial court to correct any errors, and a sufficient record for an appellate court to review those errors.
